$19M Settlement Reached in Malpractice Suit


A jury in Monmouth County, NJ, recently awarded $19 million to a mother in a medical malpractice suit. The suit was filed after the woman’s son was born with cerebral palsy and blamed her obstetrician for the child’s disabilities.

Complications in Pregnancy

Bonnie Kowalski reportedly went to the Riverview Medical Center after complaining to her obstetrician, Dr. Aravind Palav, about severe pain in her abdomen. At the time, Kowalski was only 30 weeks into her pregnancy. Palav assumed his patient was experiencing appendicitis and ordered a surgeon to perform an appendectomy. The surgeon on duty reportedly discovered an excess of blood located in her abdomen.

Doctor Warned

A nurse who was involved in with Kowalski reportedly warned Palav that the baby was in distress during the operation but he failed to listen to her concerns. A c-section was eventually performed and Kowalski’s son, Brandon, was born with severe brain damage due to oxygen deprivation.

Mother Files Suit

Kowalski claimed in the suit that Palav didn’t run the appropriate tests needed to determine what was causing the abdominal pain.
