Jury awards $510,000 for birth injuries
Xzavier Hyman was deprived of oxygen at birth, causing him to suffer brain damage, according to SILive.com. The jury found Staten Island University Hospital and an obstetrician guilty of medical malpractice.
Within 10 hours of his birth, Xzavier suffered three seizures and three or four strokes, reports the news source.
Xzaviers mother, Marquita Spicer, said she was pleased that she and her son won the case but was disappointed with the amount the jury awarded.
"I believe it was an awesome verdict and justice was served, but I also feel the award is not enough," Spicer told the news provider. "I know he'll have the lesions on his brain for the rest of his life."
Jeffrey Guzman, the attorney who represented Spicer and her son, said he was happy with the jurys verdict.
"I was grateful that the jury was able to understand the complicated nature of the case, and they realized there was malpractice," he said. "There was no reason to expect she was going to have anything but a completely healthy baby boy."
Birth injuries can often times lead to cerebral palsy.
