Settlement Reached in Fresno for Birth Injuries
August 27 , 2007
A mother from Fresno, California who gave birth to a child who has cerebral palsy has reached a settlement in the suit filed against the hospital.
Although the delivery happened a little over a decade ago, the settlement enabled the parents of the child to be compensated for the wrongdoing and their son’s disabilities.
Boy Born with Cerebral Palsy
Gabriela Enriquez gave birth to her son, Jose, at the Sierra View District Hospital, and at the time of his delivery, he suffered from extreme brain damage due to a lack of oxygen.
As a result of his birth injuries, Jose is now living with cerebral palsy and doctors say his motor skills are not, and may never be, what they should.
Sierra View Hospital Blamed
Enriquez filed the lawsuit against Sierra View Hospital blaming them for her son’s current health complications.
“Over the last several hours of labor, evidence on the fetal monitor demonstrated the baby was in distress, but that was ignored by nurses and the obstetrician on duty,” explains Enriquez’s attorney, Bruce Fagel.
Due to his cerebral palsy, Jose is not expected to be able to walk or communicate normally throughout the duration of his life.
Victim and Family Receive Compensation
According to reports, Sierra View Hospital has agreed to pay $4 million in the settlement to Gabriela and Jose.
Jose will also receive $45 million over his lifetime for the injuries he has endured.
