"
$26M Settlement Reached in Birth Injury Suit"

October 16, 2007

A Massachusetts family was recently awarded $26 million in the lawsuit they filed against the doctor's who delivered their son in 1997.

Up until the point the family had no real answers or closure in regards to what happened the day of the delivery that left the boy with cerebral palsy.

Suit Filed Against Doctors

Dr. Julie D. Miner and Dr. Alisa B. Goldberg were named as the defendants in the suit for the botched delivery they performed with Jose at the Boston teaching hospital.

According to the complaint, the women failed to recognize signs of fetal distress until too late in the delivery and didn't perform the Caesarean section soon enough.

Settlement Reached

"It's a relief. We finally found out what happened to Jose," said Jose Bejarano Sr., the father of the now 10- year-old boy who now receives around the clock care due to his physical condition.

The Bejarano's say that they are going to put most of the money towards Jose's medical care and to benefit his life.

"It's for him, just to make his life better," stated Bejarano.
